政府普法文本语力分析及对新生代农民工法律认知的影响研究

CHAPTER ONEINTRODUCTION

1.1 Research Topic
Ever since 2004, the Central Committee of the CCP has made “three rural issues:agriculture, rural areas and farmers” as its main focus of work. In the “NO 1 CentralDocument of 2010” issued by the Central Committee of the CCP and the StateCouncil, the concept of “New Generation Migrant Workers” was brought up. In thedocument, appropriate measures are called for solving the problems of the NewGeneration Migrant Workers. Migrant workers have made great economic andpolitical contribution for the society, and they are the key point for the rural-urbanintegration. But this huge marginalized group has been faced with a lot of legalproblems due to their lack of legal consciousness and relevant legal knowledge.Compared with their great contribution to the society, their legal rights are underconstant infringement. It has largely influenced the construction of HarmoniousSociety. The key step to solve this problem is to cultivate the legal cognition ofmigrant workers to protect their own legal rights and change their conventional andpartial legal thoughts.This change can be made by providing legal publicity and Education work to themigrant workers. Legal professionals have made a great effort in this work, and as aresult some migrant workers do have a better understanding of the law and legalsystem. But there are also many problems with the present work.The legal publicity documents provided by the government are the main sourcesfor the legal publicity work, despite the fact that these years multimodal discoursessuch as cartoons and videos are widely applied in legal publicity. The present studytries to find a solution from the linguistic perspective by making modification of theoriginal legal publicity readings and make an empirical study to testify the solution.

1.2 Preliminary Definitions
Every advance in culture, it has been said, commences with a new period ofmigration and movement of populations. To define the New Generation MigrantWorkers, we have to know first the meaning of Migrant Workers. It refers to the groupof people who has the agricultural residence but don’t work in the agricultural fieldand live on wages instead. They are entitled by the government the right to use landbut they leave the rural area and their lands to work in urban areas while possessingno urban identity. They are called migrant workers or peasant workers because of tworeasons: first is their identity. Although they are working in the cities, the people withurban residence still take them as farmers; the second is their occupations: most ofthem are taking non-official jobs or marginal jobs such as miners, building workers,waiters, nannies, or securities which people in the urban area wouldn’t want to take asa job. Under China’s dual household registration systems of urban and rural places,this group of people is easily marginalized. They make no less contribution to thedevelopment of the city but cannot enjoy equal rights and become the disadvantagedgroup in cities.The New Generation Migrant Workers refers to those migrant workers born after80th and above the age of 16. According to the latest statistics released by theNational Bureau of Statistics of PRC, the New Generation Migrant Workers has madeup 60% of the total number of migrant workers. They are very different from the firstgeneration of migrant workers in many ways. First of all, they are more educated than the first generation. Most of them have been to at least middle school unlike the firstgeneration that are most illiterate or only have primary school education. Secondly,they come to the city not only for money to make a living which is the onlymotivation of the first generation. They come to change their lifestyle and to look forbetter opportunities for their future. That means they have the basic consciousness oftheir own rights.
